These Terms of Service (“Terms”) govern access to and use of www.wordsandwiggles.com and the games, printable materials, software, subscriptions, and other products or services offered by Words & Wiggles LLC (“Words & Wiggles,” “we,” “us,” or “our”), collectively referred to as the “Services.”
By creating an account, purchasing a subscription, accessing paid content, or otherwise using the Services, you agree to these Terms. If you do not agree to these Terms, do not use the Services.
Words & Wiggles provides interactive games, printable resources, activities, and other materials designed primarily for speech-language pathologists, occupational therapists, educators, parents, caregivers, and others working with children. The Services are intended to supplement educational and therapeutic activities and are not a substitute for individualized professional evaluation, diagnosis, treatment, or judgment.
Words & Wiggles subscriptions and accounts are intended for adults who are legally capable of entering into a binding agreement. Children may use Words & Wiggles games and activities under the supervision or direction of an appropriate adult, but children do not create individual Words & Wiggles accounts.
If you allow a child to use the Services through your account, you are responsible for supervising that use.
You agree to provide accurate information when creating an account and to keep account information reasonably current. You are responsible for maintaining the confidentiality of your login credentials, activity occurring through your account, preventing unauthorized access, and promptly notifying us of suspected unauthorized access.
You may not sell, transfer, sublicense, or commercially distribute access to your account. Account sharing is permitted only to the extent expressly allowed by the subscription plan purchased.
Certain Words & Wiggles content requires a paid subscription. The features, permitted number of users, pricing, billing period, and other conditions applicable to each subscription plan will be described at the time of purchase.
Payments and recurring subscription charges are processed through Stripe. By purchasing an automatically renewing subscription, you authorize Words & Wiggles and Stripe to charge the applicable subscription fee using your selected payment method for each renewal period until cancellation.
Unless otherwise stated at checkout, subscriptions automatically renew for successive billing periods until canceled.
You may cancel an automatically renewing subscription through the cancellation method made available by Words & Wiggles. Cancellation prevents future renewal charges but generally does not terminate access before the end of the subscription period already paid for. Unless required by law or expressly stated otherwise, partial subscription periods are not prorated.
Except where otherwise required by law or stated in a specific offer, payments are non-refundable after access to digital subscription content has been provided. Words & Wiggles may issue refunds or credits at its discretion for duplicate charges, billing errors, or significant technical problems that prevent reasonable use of purchased Services.
Nothing in this section limits any non-waivable consumer rights provided by applicable law.
Subject to these Terms and payment of any applicable fees, Words & Wiggles grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Services for the purposes permitted by your subscription plan.
Unless otherwise indicated, an individual professional subscriber may use Words & Wiggles resources with the students, patients, clients, or children they personally serve. You may display games or resources during individual or group educational or therapeutic sessions consistent with your subscription. Printable materials may be printed in reasonable quantities for use with individuals you personally teach, supervise, treat, or care for.
This license does not transfer ownership of any Words & Wiggles intellectual property.
Unless Words & Wiggles gives you prior written permission, you may not:
An individual subscription does not automatically grant organization-wide access. Schools, clinics, practices, districts, companies, or other organizations wishing to provide access to multiple professionals must purchase an applicable multi-user or organizational license if such a plan is offered. The permitted number of users is determined by the applicable subscription agreement or plan.
Words & Wiggles does not collect, save, or maintain personal information about children. Children do not create individual accounts, and the Services are not designed to store child profiles, names, therapy records, educational records, scores, progress, recordings, or other child-specific information.
Users must not use Words & Wiggles as a repository for protected health information, confidential educational records, medical records, or other sensitive personal information about children unless Words & Wiggles expressly introduces a feature intended for that purpose and provides appropriate terms and disclosures.
Words & Wiggles provides educational tools and general resources. The Services do not constitute medical advice, speech-language pathology diagnosis, occupational therapy diagnosis, psychological advice, clinical recommendations, or a treatment plan.
Professionals using Words & Wiggles remain responsible for determining whether particular activities are appropriate for a specific student, client, patient, or child. Parents and caregivers should consult appropriate professionals regarding medical, developmental, therapeutic, or educational concerns.
The Services and their contents are owned by or licensed to Words & Wiggles LLC and are protected by applicable copyright, trademark, trade-secret, and other intellectual-property laws.
Protected materials may include games, software, source code, artwork, illustrations, characters, animation, sound effects, music, game designs, logos, branding, website designs, worksheets, printables, written content, videos, graphics, database content, and original combinations and arrangements of content.
Except for the limited license expressly granted under these Terms, no intellectual-property rights are transferred to users.
If you voluntarily send us suggestions, ideas, feature requests, or other feedback regarding the Services, you grant Words & Wiggles permission to use that feedback to develop, improve, market, or operate the Services without compensation or obligation to you. This does not transfer ownership of unrelated intellectual property that you identify as yours.
We may add, change, update, discontinue, replace, or modify games, resources, features, or other portions of the Services. We do not guarantee that every game, printable, feature, or resource will remain available indefinitely.
We may temporarily suspend the Services for maintenance, security, upgrades, technical problems, or circumstances outside our reasonable control.
Words & Wiggles relies on third-party providers, including Stripe for payment processing, Vercel for hosting and infrastructure, and Sanity for content-management services. We are not responsible for interruptions or failures caused solely by third-party services outside our reasonable control.
Links to third-party websites do not constitute endorsement of those websites or services.
We may suspend or terminate an account if we reasonably believe a user has violated these Terms, failed to pay applicable fees, shared an account in violation of the applicable license, misused or redistributed Words & Wiggles content, attempted to compromise the security of the Services, used the Services unlawfully, or engaged in fraudulent or abusive activity.
Where reasonably appropriate, we may provide notice and an opportunity to correct the violation before termination. Provisions concerning intellectual property, disclaimers, limitations of liability, dispute resolution, and other provisions that logically should survive termination will continue after termination.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WORDS & WIGGLES DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, COMPLETELY SECURE, OR SUITABLE FOR EVERY USER, STUDENT, CLIENT, OR PURPOSE. Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WORDS & WIGGLES LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO USE OF THE SERVICES.
To the maximum extent permitted by law, the total liability of Words & Wiggles arising from or relating to the Services will not exceed the greater of (a) the amount you paid to Words & Wiggles during the 12 months before the event giving rise to the claim, or (b) one hundred U.S. dollars ($100). These limitations do not apply where liability cannot lawfully be limited.
To the extent permitted by law, you agree to indemnify and hold harmless Words & Wiggles LLC and its members, managers, employees, and agents from third-party claims, damages, or expenses arising from your unlawful misuse of the Services, violation of these Terms, or infringement of another person’s rights.
These Terms are governed by the laws of the State of New York, without regard to conflict-of-laws principles, except where applicable consumer law requires otherwise. Any legal proceeding not subject to another legally required venue shall be brought in an appropriate state or federal court located in New York.
We may update these Terms from time to time. Material changes will become effective after reasonable notice where required by law. Continued use of the Services after updated Terms become effective constitutes acceptance of those Terms, except where affirmative consent is required by law.
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in effect to the maximum extent permitted by law.
These Terms, together with the Privacy Policy and any plan-specific or purchase-specific terms presented to you, constitute the agreement governing your use of the Services.
